Terms of Service

These Terms of Service ("Terms") govern your access to and use of Purse (the "Service"), operated by Aevr ("we", "our", or "us"). By creating an account or using the Service, you agree to these Terms in full.

If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using it, you represent that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

2. Account Registration

To access most features, you must create an account. You agree to:

Provide accurate information during registration
Keep your authentication credentials (PIN, passkey) secure
Notify us immediately if you suspect unauthorized access to your account
Take responsibility for all activity that occurs under your account

You may not create accounts on behalf of others without their authorization.

3. The Service

Purse provides:

A personal wallet for depositing, transferring, and withdrawing funds
Shared purses for pooling contributions toward a goal, with milestone-based payout controls
Spaces for grouping purses and members under a shared collaboration context
Public pay links (/pay/[tag]) that allow anyone to send funds to your wallet
Notifications for transaction and purse activity

The Service is provided as-is. We do not guarantee continuous, uninterrupted availability.

4. Financial Operations

4.1 Deposits

Deposits are processed through third-party payment providers (Paystack and/or 100Pay). We are not responsible for failures or delays caused by those providers.

4.2 Transfers

Wallet-to-wallet transfers are processed in real time and are generally irreversible once confirmed. You are solely responsible for verifying the recipient before initiating a transfer.

4.3 Withdrawals

Withdrawals are subject to availability of your connected payout account. We do not guarantee specific withdrawal processing times.

4.4 Purse Operations

Fund movements within purses (deposits, milestone payouts, allocation approvals) are governed by the purse configuration and the roles assigned to members. Purse owners and admins are responsible for the accuracy of their configuration.

4.5 Currency Conversion

If a transaction requires currency conversion, we apply the best available rate from our currency service. Conversion rates are indicative and may differ from market rates at the time of settlement.

5. Fees

We may charge fees for certain operations. Any applicable fees will be disclosed before you confirm a transaction. We reserve the right to introduce or change fees with reasonable notice.

6. Acceptable Use

You agree not to use the Service to:

Conduct or facilitate illegal activity, including money laundering or fraud
Send funds to or receive funds from sanctioned individuals or entities
Exploit, harm, or attempt to harm other users
Circumvent rate limits, authentication mechanisms, or access controls
Interfere with the Service's infrastructure or security

We reserve the right to suspend or terminate accounts that violate these terms.

7. Member Roles and Purse Governance

When you create or join a purse or space, your actions are governed by the role you hold (owner, admin, member, viewer, or beneficiary). As a purse owner or admin, you are responsible for:

Setting appropriate access policies
Approving or rejecting membership requests and payout requests
Ensuring funds are used in accordance with the purpose of the purse

We do not adjudicate disputes between purse members. Governance decisions are the responsibility of purse owners.

8. Pay Links

Your /pay/[tag] page is publicly accessible to anyone with the link. By enabling a pay link, you allow unauthenticated parties to initiate payments to your wallet. You are responsible for how you share this link.

9. Intellectual Property

All content, branding, and software in the Service is owned by or licensed to Aevr. You may not copy, reproduce, distribute, or create derivative works without our written permission.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

The Service will be uninterrupted or error-free
Funds will settle within a specific timeframe
Currency conversion rates will match market rates exactly

11. Limitation of Liability

To the fullest extent permitted by applicable law, Aevr shall not be liable for:

Indirect, incidental, or consequential damages
Loss of funds resulting from your account credentials being compromised
Losses caused by third-party payment provider failures
Any loss arising from unauthorized access to your account that results from your failure to secure your credentials

Our total liability for any claim arising from the Service shall not exceed the amount you paid to us in fees in the 90 days preceding the claim.

12. Indemnification

You agree to indemnify and hold Aevr harmless from any claims, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your account at any time if we believe you have violated these Terms or if we are required to do so by law. You may delete your account at any time by contacting us.

On termination, your access to the Service ends. We will handle any remaining balance in your wallet in accordance with applicable law and our operational procedures.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Lagos, Nigeria, unless otherwise required by applicable law in your jurisdiction.
